Making a personal injury claim

The personal injury claims process allows you to seek compensation and support after suffering an injury caused by someone else’s negligence.

Our team can assist with a wide range of personal injury claims, including:

This isn’t an exhaustive list, though. If you think you could have a case for compensation, get in touch for a free initial chat.

We’ll ask a few straightforward questions about what happened and let you know if you have a strong claim.

Who can make a personal injury claim?

  • You may be able to make a personal injury claim if:
  • You were injured in an accident that wasn’t your fault
  • Your accident happened within the last three years
  • Your injuries were directly caused by someone else’s negligence

In many cases, you can also claim on behalf of someone else. This will usually apply when there is a child involved, or someone who doesn’t have the capacity to manage their own claim.

How the personal injury claims process works

We aim to make the claims process as straightforward as possible. While every claim is different, it typically involves the following steps:

1. Free initial consultation
We’ll discuss the details of your accident with you and let you know if you have a strong case for compensation.

2. Building your case
If you decide to proceed, we’ll submit a claim form to the responsible party’s insurer and begin to gather evidence to support your claim.

3. Submission of losses
After putting together the necessary evidence, we’ll submit your losses to the responsible insurer. This step will only be carried out with your approval.

4. Negotiating compensation
If liability is accepted by the other side, we’ll begin to negotiate for a fair settlement.

5. Receiving compensation
Once your claim is successfully resolved and a settlement is accepted, you’ll receive your compensation. We’ll deduct our fee from the final amount (up to 35%).

Our online tool Touchpoint makes it easy for you to track your claim, so you’ll never be left out of the loop. Your solicitor will also be on hand to answer any questions you may have throughout the process.

No Win No Fee personal injury claims

We handle personal injury clams on a No Win No Fee basis. This means:

  • No upfront legal fees
  • A clear explanation of costs from the start
  • No fees to pay if your claim is successful

We will only receive a payment if your case succeeds. This could be up to 35% of your agreed settlement (plus VAT). Although our fee may be less, depending on the accident.

We’ll explain our No Win No Fee policy before starting the claims process, so you will be fully informed from the very beginning – with the reassurance there will be no hidden fees.

How much personal injury compensation will I receive?

The amount of compensation you receive for a personal injury claim will depend on a range of factors. But if your case is successful, your settlement will likely be split into general damages and special damages.

General damages relate to the pain and suffering caused by your injuries. This includes the physical and emotional impact of the accident, as well as the long-term effect on your quality of life.

Special damages cover any financial losses resulting from your accident. These can include:

  • Loss of earnings if you had to take time off work
  • Future loss of income if you’re unable to return to your current role
  • Medical treatment and rehabilitation costs
  • Travel expenses for medical appointments
  • The cost of care or assistance during your recovery
  • Damage to your personal belongings

Every claim is different and compensation amounts can vary significantly depending on the circumstances. Your solicitor will carefully assess your case and work to secure a fair settlement that fully reflects the impact your injury has had on your life.

How long do I have to make a claim?

You’ll usually have three years from the date of your accident to make a personal injury claim. But there are some exceptions to this rule:

  • If the injured person is a child, a claim can be made on their behalf at any point until their 18th birthday. They’ll then have until their 21st birthday to bring their own claim.
  • If the injured person lacks mental capacity, there will be no time limit. This will often apply in cases where someone has suffered a brain injury.

We know the thought of making a claim can be daunting, but seeking legal advice early could help you to work out exactly where you stand.
